Rubbish TakeOut Terms & Conditions of Service

This is an agreement between you and Rubbish TakeOut. Before using Rubbish TakeOut, please read these Terms and Conditions of Service carefully. By using Rubbish TakeOut, you agree to be bound by these terms. If you do not accept these terms, you may not use our services.

By subscribing to Rubbish TakeOut, you are contracting with Rubbish TakeOut LLC for the services of managing and returning your waste and recycling bins as specified at the address you provide during registration.

Definitions

“Rubbish TakeOut” refers to Rubbish TakeOut LLC and its bin management services.

“Bin Dashers” refers to the employees or contractors providing Rubbish TakeOut’s services.

Service Details

Scope of Service: Rubbish TakeOut’s Bin Dashers will retrieve your waste and recycling bins from their designated curbside location after collection and return them to their original storage area.

Service is performed weekly on your designated trash day.

Access to Property: By subscribing to Rubbish TakeOut, you authorize our Bin Dashers to access your property to perform the agreed-upon services.

It is your responsibility to ensure our team has unobstructed access to the bins (e.g., providing gate codes, ensuring pets are contained, etc.).

If our team cannot access the bins due to blocked access, you will not be entitled to a refund or credit for that service visit.

Pricing & Billing

Free Month Offer: Your first month of service is free. Regular billing begins in the second month.

Pricing: $15/month for the first 2 bins. $5/month for each additional bin. For example, 4 bins = $25/month. *Pricing changes to standard price after three (3) months.

Billing Terms: Services are billed monthly at the beginning of each month. Invoices will be sent to the email address provided during registration. Auto-pay is optional and can be set up at any time after the first month.

Late Payments: Payment is due within 7 days of the invoice date. A late fee of $5 may be applied to overdue accounts.

Sales Tax: All applicable state and local taxes will be added to your monthly invoice.

Service Changes & Cancellation

Modifications: Service changes, such as bin count or schedule adjustments, require at least 7 days' notice.

Cancellation: Service can be canceled by either party with at least 30 days' written notice. Cancellation must be submitted via email at info@rubbishtakeout.com or through your customer account on our website. No refunds or credits will be issued for unused portions of a billing period.

Customer Responsibilities

Bin Accessibility: Ensure bins are accessible on service days, including: Gate codes or combinations provided in advance. Pets kept away from the service area. Clear paths to bins.

Vehicles & Property: Rubbish TakeOut is not responsible for damage to bins caused by vehicles or external factors, such as weather, vandalism, or misuse.

Liability

Service Disruptions: Rubbish TakeOut is not responsible for missed services due to weather, natural disasters, or other uncontrollable circumstances.

Damages: Rubbish TakeOut is not liable for damage to bins or property unless caused by gross negligence. The homeowner is responsible for maintaining compliance with city codes regarding fencing, gates, and trash storage.

Pricing Changes

Rubbish TakeOut reserves the right to change its pricing. Any adjustments will be communicated via email with at least 60 days’ notice. If you do not agree with the new pricing, you may cancel your service.

Pets

It is the customer’s responsibility to ensure pets are secured and do not interfere with service.

Customer Satisfaction

Our goal is your complete satisfaction. If a service issue arises, please notify us within 7 days at info@rubbishtakeout.com so we can address the matter promptly.

Changes to Terms

Rubbish TakeOut reserves the right to update these terms at any time. By continuing to use our services after changes are made, you agree to the updated terms.

Dispute Resolution

Any disputes arising from this agreement are subject to the laws of the State of California and shall be resolved through binding arbitration.

Disclaimer

Under this agreement, Rubbish TakeOut is not responsible for damage to bins caused by natural disasters, fire, vandalism, misuse, or vehicles.
